Right to Trial by Jury

        -6th Amendment

        -Some minor offenses—no jury trial

                -Usually crimes in which punishment is less than 6 months in jail

        -Defendant can “waive” trial by jury

                -“Bench” trial

        -Federal casesà12 members

                -Other casesà6 to 12 members

        -Believe it or not…Supreme Court does not require unanimous verdicts for state crimes 

        -How do you get a jury?

                -Jury pool

                        -Voter registration rolls, tax lists

                -Potential jurors sent notice to attend jury selection

                        -Must attend or give reason why not

                        -Prosecutor and defense question jurors

                                -Peremptory challenge

                                        -Excluding a potential juror from serving

                                        -No reason has to be given for exclusion

 

Right to Speedy Trial

        -6th Amendment

        -What is “speedy”?

 

Right to Compulsory Process

        -Subpoena

                -Court order requiring someone to testify

 

Freedom from Self-Incrimination

        -Defendant does NOT have to testify
